I don't think it's uncommon for someone to playfully see how far they can get with a sleeping partner... you've never woke up to your lover trying to sneak on to your morning wood without waking you? I guess that would be the same thing, no? C'mon... you never pretended to still be sleeping to not interrupt her while she rides your "sleeping" body... heheh. The key point being that they know their lover enough to know that they would respond positively to the situation, not freak out.
But if there is a possibility (probability?) that she would take surprise sex as an assault... that would be an assault... no bones (haw) about it.
