I disagree with pretty much every part of that statement.
fortune: Nope. We're not talking about a team of lawyers pouring over the source here. We're talking about an hour or two conversation about the how the current license evolved, where you'd like to take it, and what needs to happen to get there in a way that would be defensible should the situation arise. Hell, supposedly Haze did it all his lonesome which, for all his bluster, was the most logical thing done in this whole debacle and it was viewed as a threat.
incorrect advice: That's the thing about losing ... it doesn't mean the lawyer made any misstep. It often means the client was an idiot ... and ... you know ... avoided seeking legal advice when it would have actually been able to help.
a situation that will never happen: "you have to accept that it's likely you'll get sued someday". Might not happen to the MAME team directly but by your own admission it's inevitable to the sort of people this change is supposedly catering to.
