How the F can 1upArcade be selling MAME???

So it seems these 1upArcade garbage cabinets are being sold with older MAME cores in them. How is this legit? Did somebody cut a deal?

are the new ones using pre-GPL MAME too? It was communicated to me that they had learned from their 'mistake' with the older ones and weren't using old MAME for the newer ones.
(although if they're using something else like FBA, it's no better as that's strictly non-commercial too)
Unfortunately all I've encountered anywhere trying to point this problem out is abuse, and my comments / posts being deleted, so the 'community' seems to be very much behind these guys, and against MAME (but still want support from us to hack the things, even if we have no idea what changes they've made)

How many of these mini consoles, mini arcade and mini handled are being made these days ? It's out of control...
And pretty much all of them are being sold with mame with a bunch of roms. Also a lot of nintendo stuff obviously such as super mario.
I saw them being sold in stores such as Walmart as so on. What the hell... I don't get it.
The emulation is terrible... bad video, bad audio, bad controls, lag, etc.
