In my opinion, if you don't have what you need of Nintendo ROMs by now, you have nobody to be upset at but yourself. For years Nintendo ROMs have been easily found. If you don't have what you need from Nintendo, what are you waiting for?

Their efforts would be better spent securing their latest consoles and handhelds rather than worrying about 'retro' roms.
And then there's cemu and people emulating current gen games which can still be bought through retail channels.
But we must stop teh retro roms!

For everyone one of those rom sites that a company like Nintendo shuts down, 20 more will appear in countries that pay no attention to, or outright flout, copyright laws.

I'm not a lawyer but last I read about it, there is a part of copyright law states that if you don't make an effort to protect your works then you can lose the rights to them, so by starting this lawsuit they just protected themselves. I would guess that is their point and they just put up with the slightly bad PR.

You're thinking of US trademark law. There's no such law for copyright.

I don't think the lawyers would be able to help do that.
nVidia have issued a fix for fusee gelee which is already in production and turning up at retail.

What they call for and what they get are two different things. You don't go in low.
Earning money using ads and subscriptions and running it through the US seems like a really silly thing to do...
