You can be 100% sure that anything that has titles owned by Nintendo is 100% not legal since Nintendo has never allowed its older games (arcade, console or otherwise) on hardware platforms other than its own.

Any xxx-in-1 arcade cabinet/board/etc that claims to be "100% legal" but has anything from Nintendo on it is 100% NOT legal since Nintendo has (to the best of my knowledge) never allowed its arcade titles to be distributed anywhere other than the original arcade PCBs.
